Introduction

As a seller on Plactive Pvt Ltd, you agree to comply with all applicable laws, regulations, and our platform policies. The information provided here is for general informational purposes and does not constitute legal advice. We encourage you to consult with legal counsel if you have any questions regarding the laws and regulations applicable to your products.

Before listing your products on our platform, please review the “Examples of Prohibited Product Listings” sections relevant to your product categories. Additionally, be aware that there are restrictions on the import and export of various products.

“You may use the provided tool to check whether your product is included in Plactive’s prohibited listings by consulting the provided list. However, this list does not constitute final approval for selling on the platform / website. Sellers are solely responsible for conducting thorough research to determine if their product is subject to government-imposed restrictions or falls under any banned product category.”

Consequences for Violations

  1. Listing products that violate our policies or applicable laws and regulations may result in the following actions:
  2. Cancellation of your product listing
  3. Restrictions on your listing privileges
  4. Suspension of your listing privileges
  5. Removal of your listing privileges
  6. Termination of your agreement with Plactive Pvt Ltd

Notification to relevant governmental, legal, and regulatory authorities for further action

Plactive Pvt Ltd reserves the right to make decisions regarding the appropriateness of listings and whether they comply with our policies.

Reporting

If you discover any product listings that violate our policies or applicable laws, please report them to (create mail link). Provide all relevant information to assist us in conducting a thorough investigation.

Products and Services That Cannot Be Promoted

Plactive Pvt Ltd does not promote the advertising of some products and services. This list will be updated periodically, but Plactive is not bound to notify sellers of updates. It is the responsibility of the seller to investigate applicable laws and restrictions before offering any products. Any edible product should have the required certifications from the relevant government department.

For clarity, advertisements running off internet are permitted. Branding campaigns are also permitted, provided they do not feature an identifiable HFSS (High in FAT, SALT and SUGAR) product and they are permitted as per the Food safety and standards act, 2006 no. 34 of 2006. Food safety and standards rule, 2011.

  13. Fertility clinics and research.
  14. Free eBooks (except pre-approved)
  15. Get-rich-quick and pyramid schemes.
  16. Handgun safety certificates.
  17. Illicit and recreational drugs, drug paraphernalia, drug testing equipment, or products to beat drug tests.

Products, services, technology, or website content that:

Infringes, encourages, or enables the infringement of the intellectual property or personal rights of others, or

Promotes any illegal or dangerous activity, including false document services, counterfeit designer goods, cable descramblers, fireworks, or websites that promote hacking or evading law enforcement.

Psychics and related content.

  1. Products that are ineligible for sale or do not comply with Plactive Pvt Ltd Category, Product, and Listing Restrictions.
  2. Religious or spiritual services.
  3. Shock collars (including pet training collars with any type of shock function) and pinch or choke collars.
  4. Any kind of loan, grant, MLM, monetary transactions scheme.
  5. “Stripper” or dancing poles.
  6. Any spy cam and/or voice bug disguised as an everyday item capable of transmitting video/audio via WIFI/GRMS/IP/GSM/Bluetooth to someone else without the person knowing they are being recorded (Germany only).
  7. Tattooing and body branding products and services.
  8. Testosterone boosters.
  9. Travel Ticket resellers
  10. UV tanning services and equipment.
  11. Weapons
  12. Collectible Coins
  13. Collectible Paper Money
  14. Counterfeit coins and paper money, including Bank notes, Bonds and Money orders.

  18. Cash or cash equivalent instruments, including money orders, traveller’s cheques, stored value products like retail or open loop gift cards or electronic stored value redemption codes.
  19. Items made of Gold, silver or other precious metal bullion.
  20. Imitation and prop money that is not conspicuously marked “Copy” including: Coins, Tokens, Paper Money, Commemorative medal.
  21. Most live creatures (pets, livestock, marine mammals) Illegal wildlife products Insects or creatures labelled as “plant pests”.
  22. Parts or products from endangered species (cheetahs, jaguars, leopards, mountain zebras, Hartmann Mountain zebras, sable antelopes, tigers or anything which fall under the (Wildlife Protection Act 1972.)
  23. Parts or products produce from any dead or living being, bird, animal, reptile etc, products made from ivory or bones of animals are prohibited by law cannot be traded or advertised.
  24. All books are permitted to be listed unless falling in the restricted list of titles which are prohibited by the Government. Books considered for children above 12 years will require screening / approval before listing.
  25. The seller is solely responsible for finding out and research about the restrictions on the book before listing.

Distorted India map

Distorted India map means and includes any map of India in which India’s international boundaries are not correctly depicted. The correct depiction of the map of India indicating the accurate international boundaries is provided on the official website of the Survey of India (“SOI”).

All types of non-media products that have any image of a distorted India map are restricted, along with media products (including e-books) that have a pictorial representation of a distorted map of India.

As per Section 2(2) of the Criminal Law Amendment Act, 1961, incorrect depiction of the international boundaries of India is a punishable offence. Publishing a map of India that is not in conformity with the maps of India as published by the Survey of India is not permitted on any listing of Plactive.com

  7. Products that depict children (including boys, girls, baby) and youth (including boys, girls) in a sexually suggestive manner or a manner that encourages child sex acts, child nudity, child profanity, child drug use or profanity.
  8. Graphic pornographic or nude paintings/ prints
  9. Products that promote xenophobia and hate against immigrant and refugee groups
  10. Paintings/ Prints that are not legally approved for sale or reproduction of artwork that violate any copyright.
  11. Paintings/ Prints that Plactive deems offensive are prohibited from listing on Plactive.in. Plactive reserves the right to determine the appropriateness of listings on its site, and remove any listing at any time.
  12. Painting epigraph or other art works which are ‘antiques’ (that is, has been in existence for not less than one hundred years)
  13. Paintings/ Prints that are declared as ‘art treasures’ by Central Government notification in the Official Gazette
  14. Artwork without a named artist
  15. Artwork that is a mass-produced or commercial work that has been hand-painted (also called “brush to canvas”)
  16. Artwork that was created as a reproduction of an existing work; the artist did not deliberately make more than one version of the same artwork even if there is a named artist or the artwork otherwise meets the requirements above
  17. Promotional posters or advertisements even if they otherwise meet the requirements mentioned above
  18. Artwork in a limited edition that consists of any of the following:
  19. Estate signed or estate editions
  20. Plate signed editions
  21. Creative Commons images or editions (CC)
  22. An edition of over 200, even if numbered and hand signed or otherwise meeting the requirements above

  24. Products related to art, but that are not artworks themselves (for example, books about or containing art, posters of artwork, artwork printed on clothing, and decorative mouse pads)

Any streaming media player or other device that violates this policy is prohibited from sale on Plactive

It is your responsibility to source and sell products that do not promote, promise the facilitation of, or actively enable the infringement of or unauthorised access to digital media or other protected content. If you sell these products, then we may immediately suspend or terminate your selling privileges and dispose of inventory in our fulfilment centres without reimbursement. In addition, if we determine that your account has been used to engage in fraud or other illegal activity, remittances and payments may be withheld or forfeited
