Plactive Terms & Conditions of Use
This document is an electronic record in accordance with the Information Technology Act, 2000, and the relevant rules and regulations, as amended by the provisions pertaining to electronic records in various statutes. This electronic record is generated by a computer system and does not require physical or digital signatures.
This document is published in compliance with Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name (“Website”), including the related mobile site and mobile application (collectively referred to as the “Platform”).
The Platform is owned by Plactive Private Limited, a company incorporated under the Companies Act, 1956, with its registered office and branch office at 406, Shree Amar Heights, E11-E33, Main Ajmer Road, Jaipur, Rajasthan 302019, India (hereinafter referred to as “Plactive”).
Your use of the Platform and its services and tools is governed by the following terms and conditions (“Terms of Use”), including the applicable policies, which are incorporated by reference. If you transact on the Platform, you will be subject to the policies applicable to such transactions. By using the Platform, you are entering into a binding contract with Plactive Private Limited, and these terms and conditions, along with the policies, constitute your binding obligations with Plactive.
For the purposes of these Terms of Use, “You” or “User” refers to any natural or legal person who has agreed to become a buyer on the Platform by providing registration data while registering as a Registered User using the Platform’s computer systems. Plactive allows Users to browse the Platform or make purchases without registering. The terms “We,” “Us,” or “Our” refer to Plactive Private Limited.
ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By implicitly or explicitly accepting these Terms of Use, You also agree to be bound by Plactive’s policies (including, but not limited to, the Privacy Policy available at [Privacy]) as amended from time to time.`

MEMBERSHIP ELIGIBILITY
Transactions on the Platform are available only to individuals who can form legally binding contracts under the Indian Contract Act, 1872. Persons deemed “incompetent to contract” under the Indian Contract Act, 1872, including un-discharged insolvents, are not eligible to use the Platform. If you are a minor, i.e., under the age of 18 years, you may use the Platform or access its content only under the supervision and with the prior consent of a parent or legal guardian.
If, as a minor, you wish to transact on the Platform, such transactions must be conducted by your legal guardian or parents. Plactive reserves the right to terminate your membership and/or deny you access to the Platform if it is brought to Plactive’s attention, or if it is discovered, that you are under the age of 18 years and are transacting on the Platform.
Your Account and Registration Obligations
If You use the Platform, You are responsible for maintaining the confidentiality of Your Display Name and Password and for all activities that occur under them. If You provide any information that is untrue, inaccurate, outdated, or incomplete, or if We have reasonable grounds to suspect that such information is untrue, inaccurate, outdated, or incomplete, or not in accordance with these Terms of Use, We reserve the right to indefinitely suspend, terminate, or block Your membership and refuse to provide You with access to the Platform.
Your mobile phone number and/or email address are treated as Your primary identifiers on the Platform. It is Your responsibility to ensure that Your mobile phone number and email address are kept up to date on the Platform at all times. You agree to promptly notify Us of any changes to Your mobile phone number or email address by updating them on the Platform through one-time password verification.
You agree that Plactive shall not be liable or responsible for any activities or consequences of use or misuse of Your Account information, especially in cases where You have failed to update Your revised mobile phone number and/or email address on the Platform.
If You share or allow others to access Your account on the Platform (“Account”), whether by creating separate profiles under Your Account or otherwise, they will be able to view and access Your Account information. You are solely liable and responsible for all activities undertaken under Your Account, and any consequences thereof.
You must maintain the confidentiality of Your account information and are responsible for all activities that occur under Your account. Sharing Your login details, i.e., username and password, with any other person is considered a breach of these Terms of Use.
You agree to: (a) ensure that You log out from Your account at the end of each session; and (b) immediately notify Plactive of any unauthorized use of Your account. If there is reason to believe that there may be a breach of security or misuse of Your account, We may request that You change Your password or We may suspend Your account without any liability to Plactive for a period of time deemed appropriate under the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.
You will have access to other apps owned by Plactive group companies through the same login username and password. You agree to maintain single login access for all apps owned by Plactive group companies.
TRANSACTION & COMMUNICATIONS
When You use the Platform or send emails or other data, information, or communication to Us, You agree and understand that You are communicating with Us through electronic records, and You consent to receive communications via electronic records from Us periodically and as required. We may communicate with You by email or through other modes of communication, whether electronic or otherwise.
Platform for Transaction and Communication
The Platform enables Buyers and Sellers to transact. Plactive is not, and cannot be, a party to or control any transaction between the Platform’s Users in any manner.
Henceforward:
Commercial/Contractual Terms: All commercial and contractual terms are offered and agreed upon solely between Buyers and Sellers. These terms include, but are not limited to, price, shipping costs, payment methods, payment terms, delivery dates, delivery periods and modes, warranties related to products and services, and after-sales services. Plactive does not control, determine, advise, or involve itself in the offering or acceptance of these terms between Buyers and Sellers. All discounts and offers (including exchange offers) are provided by the Seller/Brand, not by Plactive.
Order Placement: When a Buyer places an order with a Seller on the Platform, it is an offer to purchase the product(s). This offer should not be construed as the Seller’s acceptance. The Seller retains the right to cancel any order at its sole discretion, and the Buyer will be informed via email or SMS. Any transaction price paid by the Buyer in case of such cancellation will be refunded. Additionally, the Seller may cancel orders where the quantities exceed typical individual consumption. This applies both to single orders and multiple orders for the same product. The Seller, at its sole discretion, determines what constitutes a typical individual’s consumption quantity.
No Warranties: Plactive makes no representation or warranty regarding the specifics (such as quality, value, salability, etc.) of the products or services proposed for sale or purchase on the Platform. Plactive neither implicitly nor explicitly supports or endorses the sale or purchase of any products or services on the Platform and accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
Non-performance and Breach: Plactive is not responsible for any non-performance or breach of any contract between Buyers and Sellers. Plactive cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Platform. Plactive is not obligated to mediate or resolve any disputes or disagreements between Buyers and Sellers.
User Verification: Plactive makes no representation or warranty regarding the item-specifics (such as legal title, creditworthiness, identity, etc.) of any Users on the Platform. You are advised to independently verify the bona fides of any User You choose to deal with and use Your best judgment.
No Ownership or Possession: At no point during any transaction between a Buyer and Seller on the Platform does Plactive come into possession of any products or services offered by the Seller, nor does it gain title or have any rights or claims over the products or services offered by the Seller to the Buyer.
No Obligations or Liabilities: Plactive does not hold any right, title, or interest in the products, nor does it have any obligations or liabilities regarding contracts entered into between Buyers and Sellers. Plactive is not responsible for unsatisfactory or delayed performance of services or for damages or delays resulting from products that are out of stock, unavailable, or back-ordered.
Platform as a Facilitator: The Platform is a tool that Users can utilize to reach a larger audience to buy and sell products or services. Plactive provides only a communication platform, and it is agreed that the contract for the sale of any products or services is strictly a bipartite contract between the Seller and the Buyer. At no time does Plactive hold any right, title, or interest in the products, nor does it have any obligations or liabilities concerning such contracts.
Plactive is not responsible for unsatisfactory or delayed performance of services, or for damages or delays resulting from products that are out of stock, unavailable, or back-ordered.
BUSINESS PURCHASES ON THE PLATFORM
Certain products offered by sellers on the Platform may be eligible for business purchases.
GST Input Tax Credit: Upon purchasing product(s) eligible for business purchases, You may be able to avail the benefits of GST input tax credit. At Your request, an invoice containing the GSTIN provided by You (“Tax Invoice”) shall be issued by the Seller(s) selling such products.
The GST invoice will include, among other details:
The GSTIN associated with Your registered business, as provided by You.
The entity name of Your registered business, as provided by You.
Not all products are eligible for business purchases on the Platform, and this eligibility is solely at the discretion of the Sellers. The eligibility of a Tax Invoice will be visible on the product page.
Purchases on the Platform must be for end consumption only. Products purchased on the Platform must not be used for any commercial, promotional, resale, or further distribution purposes.
To seamlessly avail of input tax credit, please ensure that the delivery address matches the registered place of business as per GST authority records. Availment of input tax credit is subject to the provisions of the GST Act and rules.
The delivery and billing addresses must be the same. Please note that input tax credit will be denied by the GST authority if the delivery address and GSTIN on the GST invoice are from different states.
If You do not provide GSTIN and/or business entity details, it will be presumed that the purchase is personal, not for business.
Plactive is not responsible for verifying the correctness of the GSTIN and/or entity name provided by You. You are entirely responsible for providing accurate details.
Plactive and the Seller will not entertain any requests for revisions to the GST Invoice. Neither Plactive nor the Seller will be liable for any issues arising from incorrect details provided by You.
Plactive will not be liable if You are unable to avail of input tax credit or if it is denied for any reason whatsoever.
You are solely responsible for all compliances required under applicable laws.
You agree to indemnify and hold Plactive and the Seller harmless from any losses, claims, costs, expenses, suits, proceedings, or any other liability, including third-party claims (such as penalties imposed by governmental authorities) arising out of or in connection with (1) the GSTIN and/or entity name provided by You, (2) the input tax credit claimed by You or Your use or misuse of the GST Invoice, and (3) Your non-compliance with applicable laws, or (4) Your use or misuse of any third party’s details, including GSTIN.
Plactive reserves the right to disallow business purchases on the Platform if fraudulent activity is identified.
The Seller reserves the right not to issue a Tax Invoice or to issue a credit note against an already issued Tax Invoice to cancel the transaction if any fraudulent activity is identified.
Independent Agreement: You shall independently agree upon the manner and terms of delivery, payment, insurance, etc., with the Seller(s) You transact with.
Disclaimer: The pricing of any product(s) reflected on the Platform may be incorrectly displayed due to technical issues, typographical errors, or inaccuracies in product information provided by the seller. In such events, the seller may cancel your order(s).
Indemnification and Release: You release and indemnify Plactive and its officers and representatives from any costs, damages, liabilities, or other consequences arising from the actions of Users on the Platform. You specifically waive any claims you may have in this regard under applicable law. Despite its reasonable efforts, Plactive cannot take responsibility for or control the information provided by other Users that is made available on the Platform. You may find other Users’ information offensive, harmful, inconsistent, inaccurate, or deceptive. Please exercise caution and practice safe trading when using the Platform. There are inherent risks in dealing with underage persons or people acting under false pretences.
CHARGES
Plactive may charge a nominal fee for browsing and buying on the Platform. Plactive reserves the right to change its Fee Policy from time to time. In particular, Plactive may, at its sole discretion, introduce new services/fees and modify some or all of the existing services/fees offered on the Platform. In such cases, Plactive reserves the right to introduce fees for new services or amend/introduce fees for existing/new services as applicable. Changes to the Fee Policy will be posted on the Platform, and such changes will become effective immediately after being posted. Unless otherwise stated, all fees will be quoted in Indian Rupees. You are solely responsible for complying with all applicable laws, including those in India, for making payments to Plactive Private Limited.
USE OF THE PLATFORM
You agree, undertake, and confirm that your use of the Platform shall be strictly governed by the following binding principles:
You shall not host, display, upload, modify, publish, transmit, update, or share any information that:
Belongs to another person and to which You do not have any rights;
Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, related to or encouraging money laundering or gambling, or otherwise unlawful in any manner; or unlawfully threatening or unlawfully harassing, including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
Is misleading in any way;
Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
Harasses or advocates harassment of another person;
Involves the transmission of “junk mail,” “chain letters,” unsolicited mass mailing, or “spamming”;
Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libellous;
Infringes upon or violates any third party’s rights, including, but not limited to, intellectual property rights, privacy rights (including unauthorized disclosure of a person’s name, email address, physical address, or phone number), or rights of publicity;
Promotes an illegal or unauthorized copy of another person’s copyrighted work (see “Copyright complaint” below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, or providing information to circumvent manufacturer-installed copy-protection devices;
Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
Provides material that exploits people in a sexual, violent, or otherwise inappropriate manner, or solicits personal information from anyone;
Provides instructional information about illegal activities, such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
Contains videos, photographs, or images of another person (whether a minor or an adult);
Attempts to gain unauthorized access to or exceeds the scope of authorized access to the Platform or profiles, blogs, communities, account information, bulletins, friend requests, or other areas of the Platform, or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
Engages in commercial activities and/or sales without Our prior written consent, such as contests, sweepstakes, bartering, advertising, pyramid schemes, or the buying or selling of “virtual” products related to the Platform. Throughout these Terms of Use, Plactive’s prior written consent means a communication coming from Plactive’s Legal Department specifically in response to your request and addressing the activity or conduct for which You seek authorization;
Solicits gambling or engages in any gambling activity which We, at our sole discretion, believe is or could be construed as illegal;
Interferes with another User’s use and enjoyment of the Platform or any other individual’s use and enjoyment of similar services;
Refers to any Platform or URL that, in Our sole discretion, contains material that is inappropriate for the Platform or any other Platform, or contains content that would be prohibited or violates the letter or spirit of these Terms of Use;
Harms minors in any way;
Infringes any patent, trademark, copyright, or other proprietary rights, or third party’s trade secrets, or rights of publicity or privacy, or is fraudulent, or involves the sale of counterfeit or stolen products;
Violates any law for the time being in force;
Deceives or misleads the addressee/users about the origin of such messages, or communicates any information that is grossly offensive or menacing in nature;
Impersonates another person, including but not limited to, customers, employees, or any other individuals, by providing false information, creating fake accounts, or using any means to mislead or deceive.
Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs, or other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept, or expropriate any system, data, or personal information;
Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense, prevents the investigation of any offense, or insults any other nation;
Is false, inaccurate, or misleading.
You shall not, directly or indirectly, offer, attempt to offer, trade, or attempt to trade in any item, the dealing of which is prohibited or restricted under any applicable law, rule, regulation, or guideline in force.
You shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider (“ISPs”) or other suppliers.
PROHIBITED ACTIVITIES
You shall not use any “deep-link”, “page-scrape”, “robot”, “spider”, or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Platform or any Content, or to reproduce or circumvent the navigational structure or presentation of the Platform or any Content to obtain or attempt to obtain any materials, documents, or information through any means not purposely made available through the Platform. We reserve the right to bar any such activity.
You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform, or to any server, computer, network, or services offered on or through the Platform, by hacking, password “mining”, or any other illegitimate means.
You shall not probe, scan, or test the vulnerability of the Platform or any network connected to the Platform nor breach the security or authentication measures on the Platform or any network connected to the Platform. You may not reverse look-up, trace, or seek to trace any information on any other User or visitor to the Platform, including any account on the Platform not owned by you, or exploit the Platform or any service or information made available or offered by or through the Platform to reveal any information, including but not limited to personal identification or information, other than your own information as provided for by the Platform.
You shall not make any negative, denigrating, or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us, including the terms Plactive, Plactive.com, or otherwise engage in any conduct or action that might tarnish the image or reputation of Plactive or sellers on the Platform, or dilute any of Plactive’s trade or service marks, trade names, and/or goodwill associated with such trade or service marks or trade names as may be owned or used by us. You agree not to take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or Plactive’s systems or networks, or any systems or networks connected to Plactive.
You agree not to use any device, software, or routine to interfere with or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform.
You may not forge headers or otherwise manipulate identifiers to disguise the origin of any message or transmittal you send to Us on or through the Platform or any service offered on or through the Platform. You may not impersonate any other individual or entity.
You may not use the Platform or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity that infringes the rights of Plactive and/or others.
You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as amended from time to time, as well as all applicable domestic laws, rules, and regulations (including Exchange Control Laws or Regulations in force) and international laws, foreign exchange laws, statutes, ordinances, and regulations (including but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Customs Duty, Local Levies) regarding your use of our services and your listing, purchase, solicitation of offers to purchase, and sale of products or services.
You shall not engage in any transaction in an item or service prohibited by any applicable law, including exchange control laws or regulations in force.
To enable Us to use the information you provide without violating any rights you might have in your information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, database rights, or any other rights you have in your information, in any media now known or not currently known, with respect to your information. We will only use your information in accordance with the Terms of Use and Privacy Policy applicable to the use of the Platform.
From time to time, you shall be responsible for providing accurate information relating to the products or services proposed to be sold by you. You undertake that all such information shall be accurate in all respects and shall not exaggerate or overemphasize the attributes of such products or services to mislead other users.
You shall not engage in advertising to, or solicitation of, other users of the Platform to buy or sell any products or services, including but not limited to products or services related to those displayed on the Platform or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other users via the Platform. It shall be a violation of these Terms of Use to use any information obtained from the Platform to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to another person other than us without our prior explicit consent. To protect our users from such advertising or solicitation, we reserve the right to restrict the number of messages or emails a user may send to other users in any 24-hour period, as deemed appropriate in our sole discretion. We have the right at all times to disclose any information (including the identity of persons providing information or materials on the Platform) as necessary to satisfy any law, regulation, or valid governmental request. This may include, without limitation, disclosure of information in connection with the investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena. Additionally, we can (and you hereby expressly authorize us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those involving personal injury.
We reserve the right, but have no obligation, to monitor the materials posted on the Platform. Plactive shall have the right to remove or edit any content that, in its sole discretion, violates or is alleged to violate any applicable law or the spirit or letter of these Terms of Use. Notwithstanding this right, you remain solely responsible for the content of the materials you post on the Platform and in your private messages. Such content does not necessarily reflect Plactive’s views. In no event shall Plactive assume or have any responsibility or liability for any content posted or for any claims, damages, or losses resulting from the use or appearance of content on the Platform. You represent and warrant that you have all necessary rights in and to all content which you provide and all information it contains, and that such content does not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information.
DISCLAIMER AND LIMITATION OF LIABILITY
Correspondence and Dealings with AdvertisersYour correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Platform, including payment and delivery of related products or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such advertiser. We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Platform.
Exposure to Offensive Materials and Use of Personal InformationIt is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Platform, and that you may be involuntarily exposed to such offensive and obscene materials. It is also possible for others to obtain personal information about you due to your use of the Platform, and that the recipient may use such information to harass or injure you. While we do not approve of such unauthorized uses, by using the Platform, you acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others on the Platform. Please carefully select the type of information that you publicly disclose or share with others on the Platform.
Liability for DoS/DDoS AttacksPlactive shall have all the rights to take necessary action and claim damages that may occur due to your involvement or participation in any way, intentionally or unintentionally, in DoS/DDoS (Distributed Denial of Services) attacks.
VOICE COMMAND-BASED SHOPPING FEATURE
If you choose to browse or transact on the Platform using the voice command-based shopping feature, you acknowledge that Plactive and/or its affiliates will collect, store, and use your voice inputs to customize your experience and provide additional functionality, as well as to improve Plactive’s and/or its affiliates’ products and services. The use of your voice data will be in accordance with the Plactive Privacy Policy. You accept that your use of this feature is restricted to the territory of the Republic of India. This feature may not be accessible on certain devices and requires an internet connection. Plactive reserves the right to change, enhance, suspend, or discontinue this feature, or any part of it, at any time without notice to you. Your continued use of this feature constitutes your acceptance of the terms related to this feature.
TRANSLATION FEATURES
You acknowledge and agree that the Hindi, Telugu, Tamil, Kannada, Marathi, Bengali, Gujarati, Odia, Malayalam, Punjabi, and Assamese translation features are made available on the Platform on a reasonable effort basis for convenience only, without any representation or warranties by Plactive, express or implied, including the translations being error-free, accurate, complete, or reliable. Under the translation feature, you will have the option to add delivery addresses in the language selected by you from the featured languages. Such delivery addresses shall be transliterated into English for processing, handling, and fulfilling your orders on the Platform. Plactive expressly disclaims any liability of any nature whatsoever arising from or related to the said translation/transliteration features on the Platform. Some features and sections on the Platform may not be translated into the language selected by you, and the English version will be the definitive version. In the event of any conflict or inconsistency between the translated terms and the English version available on the Platform, the English version shall prevail. This feature may not be accessible on certain devices. Plactive reserves the right to change, enhance, suspend, or discontinue this feature, or any part of it, at any time without notice to you.
CONTENTS POSTED ON PLATFORM
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, and artwork (collectively, “Content”) are third-party user-generated content. Plactive has no control over such content as it is merely an intermediary for the purposes of these Terms of Use.
Except as expressly provided in these Terms of Use, no part of the Platform and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, Platform, or other medium for publication or distribution or for any commercial enterprise, without Plactive’s express prior written consent.
You may use information on products and services made available on the Platform for downloading, provided that you:
Do not remove any proprietary notice language in all copies of such documents.
Use such information only for your personal, non-commercial informational purposes and do not copy or post such information on any networked computer or broadcast it in any media.
Make no modifications to any such information.
Do not make any additional representations or warranties relating to such documents.
You are responsible for any notes, messages, emails, reviews, ratings, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files, or other materials or information posted or transmitted to the Platform (collectively, “Content”). Without limiting the above, Plactive does not warrant that:
The Platform will be constantly available, or available at all; or
The information on the Platform is complete, true, accurate, or non-misleading.
Plactive will not be liable to you in any way or in relation to the contents of, use of, or otherwise in connection with, the Platform. Plactive does not warrant that this site, information, content, materials, products (including software), or services included on or otherwise made available to you through the Platform; their servers; or electronic communications sent from us are free of viruses or other harmful components.
Nothing on the Platform constitutes, or is meant to constitute, advice of any kind. All products sold on the Platform are governed by different state laws. If a seller is unable to deliver products due to implications of these laws, the seller will return or give credit for any amount received in advance for the undelivered products.
Phone Number Consent
You will be required to enter a valid phone number while placing an order on the Platform. By registering your phone number with us, you consent to be contacted by us via phone calls, SMS notifications, mobile applications, and/or any other electronic mode of communication regarding order, shipment, or delivery updates.
TRANSACTIONS AND PAYMENT FACILITY
Payment
While using any of the payment methods available on the Platform, we will not be responsible or assume any liability for any loss or damage arising directly or indirectly due to:
Lack of authorization for any transaction(s), or
Exceeding the preset limit mutually agreed upon between you and your bank(s), or
Any payment issues arising out of the transaction, or
Decline of transaction for any other reasons.
All payments made for purchases or services on the Platform must be in Indian Rupees (INR) acceptable in the Republic of India. The Platform will not facilitate transactions in any other currency.
Before shipping or delivering your order, the seller may request you to provide supporting documents (including but not limited to government-issued ID and address proof) to verify the ownership of the payment instrument used for the purchase. This is to ensure a safe online shopping environment for our users.
Principal-to-Principal Relationship
Transactions, transaction prices, and all commercial terms such as delivery, dispatch of products, and/or services are based on principal-to-principal bipartite contractual obligations between the buyer and seller. The payment facility is merely used by the buyer and seller to facilitate the completion of the transaction. Use of the payment facility does not render Plactive liable or responsible for non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, non-provision of after-sales or warranty services, or fraud concerning the products and/or services listed on Plactive’s Platform.
Authorization and Independent Contractor
You have specifically authorized Plactive or its service providers to collect, process, facilitate, and remit payments and/or the transaction price electronically or through Cash on Delivery to and from other users in respect of transactions through the payment facility. Your relationship with Plactive is on a principal-to-principal basis, and by accepting these Terms of Use, you agree that Plactive is an independent contractor for all purposes. Plactive does not control or have liability for the products or services listed on Plactive’s Platform that are paid for using the payment facility. Plactive does not guarantee the identity of any user nor does it ensure that a buyer or seller will complete a transaction.
Nature of Payment Facility
You understand, accept, and agree that the payment facility provided by Plactive is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online payment, receiving payment through Cash-on-Delivery, collection, and remittance facility for transactions on the Plactive Platform using the existing authorized banking infrastructure and credit card payment gateway networks. Further, by providing the payment facility, Plactive is neither acting as a trustee nor acting in a fiduciary capacity with respect to the transaction or the transaction price.
Payment Facility for Buyers
Contractual Obligation
As a buyer, you understand that by initiating a transaction, you are entering into a legally binding and enforceable contract with the seller to purchase the products and/or services from the seller using the payment facility. You shall pay the transaction price through your issuing bank to the seller using the payment facility.
Extension/Increase in Dispatch and Delivery Time
You, as a buyer, may agree with the seller through electronic communication and records using the automated features provided by the payment facility on any extension or increase in the dispatch and/or delivery time. The transaction shall stand amended to such extent. Any extension or increase of dispatch/delivery time or subsequent novation/variation of the transaction must comply with payment facility rules and policies.
Notification of Delivery or Non-Delivery
You, as a buyer, shall electronically notify the payment facility using the appropriate Plactive Platform features immediately upon delivery or non-delivery within the time period specified in the policies. Failure to notify within the specified time shall be construed as deemed delivery for that transaction. For cash-on-delivery transactions, you are not required to confirm the receipt of products or services.
Refund Entitlement
You, as a buyer, are entitled to claim a refund of the transaction price (as your sole and exclusive remedy) if you do not receive delivery within the agreed time period or within the time provided in the policies, whichever is earlier. Failure to raise a refund claim using platform features within the stipulated time will render you ineligible for a refund.
Availability of Payment Facility
You, as a buyer, understand that the payment facility may not be available in full or part for certain categories of products and/or services or transactions as mentioned in the policies. Consequently, you may not be entitled to a refund for such transactions.
Refund Method for Non-Cash-On-Delivery Transactions
Except for cash-on-delivery transactions, refunds, if any, shall be made to the same issuing bank from which the transaction price was received or through any other method available on the platform, as chosen by you.
Refund Method for Cash-On-Delivery Transactions
For cash-on-delivery transactions, refunds, if any, will be made via electronic payment transfers.
Refund Currency
Refunds shall be made in Indian Rupees only and shall be equivalent to the transaction price received in Indian Rupees.
Electronic Payments for Refunds
For electronic payments, refunds shall be processed through NEFT/RTGS or any other online banking/electronic funds transfer system approved by the Reserve Bank of India (RBI).
Bank Support for Refunds
Refunds may be supported for select banks. If a bank is not supported for processing refunds, you will be required to provide alternate bank account details for processing the refund.
Conditional Refunds
Refunds shall be conditional and subject to recourse available to Plactive in case of any misuse by the buyer.
Additional Verification
We may request additional documents for verification purposes.
Compliance with Policies
Refunds shall be subject to the buyer complying with the policies.
Transaction Limits
Plactive reserves the right to impose limits on the number of transactions or transaction prices that may be received from an individual valid credit/debit card, bank account, or any other financial instrument directly or indirectly through payment aggregators or facilities authorized by RBI. Plactive reserves the right to refuse to process transactions exceeding such limits.
History of Questionable Charges
Plactive reserves the right to refuse to process transactions by buyers with a prior history of questionable charges, including but not limited to breaches of any agreements with Plactive, violations of any laws, or charges imposed by the issuing bank.
Pre-Approval Checks
Plactive may conduct checks before approving the receipt of buyer’s commitment to pay (for cash-on-delivery transactions) for security reasons. If Plactive is not satisfied with the credibility of the buyer or the genuineness of the transaction, Plactive reserves the right to reject the receipt of or buyer’s commitment to pay transaction price. The cash-on-delivery feature may be disabled for certain users at Plactive’s sole discretion.
Delay in Payment Confirmation
Plactive may delay notifying the payment confirmation or informing the seller to dispatch if Plactive deems it suspicious or if buyers conduct high transaction volumes to ensure the safety of the transaction and transaction price. Plactive may hold the transaction price and not inform the seller to dispatch or remit transaction price to law enforcement officials at their request or if the buyer is engaged in any illegal activity.
Limitation of Liability
The buyer and seller acknowledge that Plactive will not be liable for any damages, interests, or claims resulting from not processing a transaction/transaction price or any delay in processing a transaction/transaction price which is beyond the control of Plactive.
COMPLIANCE WITH FINANCIAL LAWS
Submission of PAN Card
As required by applicable law, if a customer makes a purchase of an amount equal to or above INR 2,00,000.00, the customer will be required to upload a scanned copy of their PAN card on the Platform within 4 days of making the purchase. Failure to do so will result in the cancellation of the purchase. The requirement to submit the PAN card arises only once; if it has been submitted already, it need not be submitted again. The order will be canceled if there is a discrepancy between the customer’s name and the name on the PAN card.
Compliance with Applicable Laws
Buyers and sellers must comply with all applicable laws, including but not limited to:
Foreign Exchange Management Act, 1999, and the rules and notifications issued thereunder
Exchange Control Manual issued by the Reserve Bank of India
Customs Act
Information Technology Act, 2000, as amended by the Information Technology (Amendment) Act, 2008
Prevention of Money Laundering Act, 2002, and the rules made thereunder
Foreign Contribution Regulation Act, 1976, and the rules made thereunder
Income Tax Act, 1961, and the rules made thereunder
Export-Import Policy of the Government of India
These laws are applicable to the respective parties using the Payment Facility and Plactive Platform.
BUYER’S ARRANGEMENT WITH ISSUING BANK
Credit/Debit Card Processing
All valid credit/debit cards and other payment instruments are processed using a credit card payment gateway or appropriate payment system infrastructure. These transactions are governed by the terms and conditions agreed upon between the buyer and the respective issuing bank and payment instrument issuing company.
Online Bank Transfers
All online bank transfers from valid bank accounts are processed using the gateway provided by the respective issuing bank that supports the Payment Facility. These transactions are also governed by the terms and conditions agreed upon between the buyer and the respective issuing bank.
CUSTOMER CONDUCT
A) Diversity, Inclusion, and Equity
Plactive fosters diversity, inclusion, and equity, and is committed to protecting individuals engaged with us as delivery partners from discrimination. We do not tolerate any discrimination based on race, social origin, caste, ethnicity, nationality, gender, gender identity and expression, sexual orientation, disability, religion or belief, age, or any other grounds.
B) Prohibition of Discrimination
Discrimination against delivery partners is strictly prohibited under all circumstances. This includes discrimination based on race, religion, caste, place of origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristics protected under applicable law.
C) Right to Limit Access
We reserve the right to withhold access to the Platform and limit your access at our absolute discretion if you engage in behaviour towards any delivery partner that is discourteous, disrespectful, abusive, or deemed inappropriate or unlawful.
D) Expected Conduct
You are expected to treat all delivery partners with courtesy and respect.
PLACTIVE’S REPLACEMENT GUARANTEE
Plactive’s Replacement Guarantee is designed to assist Buyers who have been defrauded by qualified sellers on the Platform. Notification of Defects:
Buyers must notify the seller of any defects in the product(s) at the time of delivery and/or within the applicable return policy period. The defective product(s) will be replaced subject to these terms and conditions.
Scope of Replacement:
Replacement can be for the entire product(s) or part(s) of the product(s), subject to availability with the seller.
Products Not Eligible for Return or Replacement:
Damages resulting from misuse of the product.
Incidental damage due to malfunctioning of the product.
Consumable items that have been used or installed.
Products with tampered or missing serial/UPC numbers.
Digital products or services.
Damages or defects not covered under the manufacturer’s warranty.
Products returned without all original packaging and accessories, including the box and manufacturer’s packaging, if any.
Jewellery that is ‘made to order’ at the customer’s request.
Customized Products: Any items that have been customized according to the buyer’s specifications, including but not limited to personalized gifts, engraved items, or custom artwork.
Made-to-Order Items: Products that are specifically made-to-order based on the buyer’s individual
Requirements, such as bespoke furniture, tailored clothing, or personalized jewellery.
Perishable Goods: Items that are perishable or have a limited shelf life, such as food, flowers, or plants.
Personal Care Products: Products that are used for personal hygiene or health purposes, such as cosmetics, skincare items, or medical supplies, once they have been opened or used.
Clothing and Footwear Replacement Policy:
Qualified sellers accept a 7-day exchange period subject to the following conditions:
Clothes and footwear must not be used (other than for trial), altered, washed, soiled, or damaged in any way.
Original tags and packaging must be intact. For items in branded packaging, the box should be undamaged.
Returns are not applicable for ‘made to order’ jewellery, innerwear, lingerie, socks, clothing freebies, etc.
Lifestyle Category Products:
Damaged, defective, or ‘not as described’ products in the Lifestyle category (including clothing, footwear, etc.) are covered by the 7-Day Replacement Guarantee. Suspension and Legal Action:
Plactive reserves the right to suspend, block, restrict, or cancel the account of any buyer or seller involved in fraudulent activities. This includes users who file false or misleading claims.
Plactive may initiate civil and/or criminal proceedings against users who file invalid or false claims, or provide false, incomplete, or misleading information.
Users found to be involved in fraudulent activities may face prosecution to the fullest extent of the law.
Exchange Offers
By participating in the exchange program, you agree to the following terms and conditions:
OWNERSHIP CONFIRMATION
You confirm that you are the sole and absolute owner and/or user of the device being exchanged under the buyback program.
The device you are exchanging is genuine, not counterfeit, and free from any encumbrances, liens, attachments, disputes, legal flaws, or existing agreements of sale. You have clear ownership of the device.
INDEMNITY:
You agree to indemnify and hold harmless to Plactive.com, its affiliates, and any future buyers of the device against any third-party claims, demands, costs, and expenses, including attorney fees, incurred as a result of your use of the device up to the date of exchange.
You undertake to make good any such claims or expenses.
Data Erasure:
You confirm that all data on the device will be erased before handing it over under the buyback program.
Despite manual or electronic data erasure, if any data remains accessible due to technical reasons, Plactive.com, the seller, or the manufacturer shall not be held responsible for data retrieval. You will not approach Plactive.com for data recovery.
Consent to Personal Information Processing:
You consent to the processing, transfer, and retention of your personal information provided in connection with the buyback program. This may include validation of information and administration of the program by the retailer and other involved entities.
Further Indemnity:
You agree to indemnify and hold harmless Plactive.com and any future buyer of the old device against any third-party claims, demands, costs, and expenses, including attorney fees, incurred due to your usage of the device up to the date of exchange. You undertake to make good any such claims or expenses.
Non-Returnable Device:
Once the device is sent to Plactive, it cannot be returned under any circumstances.
Simultaneous Pickup and Delivery:
The new device delivery and the old device pickup will occur simultaneously. You are required to have the old device ready for exchange at the time of the new device delivery.
Ineligible Devices:
Products distributed as gifts from state-sponsored or NGO-funded distribution programs are not eligible for exchange under this program.

Overview:
These Terms of Service (“Terms”) govern your access to and use of Plactive Video, an online over-the-top platform that provides users with live and/or on-demand audio and video content of various genres. The Content may be offered by Plactive or by third-party content providers (collectively, the “Content”).
Platform:
The Content is hosted exclusively on the Plactive mobile App (“Platform”), which is owned and operated by Plactive Private Limited (“Plactive”, “We”, or “Our”).
Scope of Terms:
This document outlines the terms and conditions related to your use of the Platform and your access to and/or consumption of the Content and/or other related services provided on the Platform (collectively, “Services”). These terms and conditions are collectively referred to as the “Terms”.
Eligibility:
The use of Plactive Services is restricted to individuals who can form a legally binding contract under the Indian Contract Act, 1872. You must be at least 18 years of age to avail the Services. Minors may only use the service under the supervision of an adult. Some content on the Platform may not be suitable for minors. Parents and/or guardians are advised to exercise discretion before allowing their children or minors to access such content.
Content Access and Usage:
The Content offered on the Platform may be provided free of cost or under terms specified by Plactive or Content Providers. These terms will be communicated to you at the time of viewing such Content or when you register with the Platform. By accepting these Terms and any additional terms communicated to you, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, and revocable permission to view the Platform and access the Services during the duration of your account with Plactive. No right, title, or interest in any Content is transferred to you.
The Platform is an interactive online service that allows users to view content across various genres. This content may be provided by Plactive or by third-party content providers. Specifically, third-party audio-video content (referred to as “Third Party Content”) is generated by external content creators (the “Content Owners”). The Platform facilitates access to such Third-Party Content by hosting it, displaying it, or integrating it through services and applications provided by other audio-video hosting, caching, or streaming service providers (the “Platform Partners”), who may have their own agreements with the Content Owners. Additionally, the Platform offers content that is either commissioned by Plactive or procured under a license or copyright agreement (referred to as “Plactive Originals”).
The content available on the Platform will include both Plactive Originals and Third-Party Content. Third Party Content is provided by Content Owners and/or Platform Partners. For detailed information about Third Party Content, including its specific terms of use, please refer to the respective terms and conditions of the Content Owners or Platform Partners. Plactive does not own, control, or have any involvement in the creation or development of Third-Party Content, whether it is uploaded or streamed by Content Owners or Platform Partners.
For all news content classified as Third-Party Content through the Platform Partners, Plactive’s role is limited to providing a uniform resource locator (URL) or web address to access and/or share such content on the Internet with users. The news content itself is provided, uploaded, streamed, and/or hosted by Content Owners, Platform Partners, and/or their respective agents or service providers. Plactive does not host, upload, or stream any news content on its servers or IT systems. Plactive does not exercise any control—physical, editorial, or digital—over the news content being viewed or provided to users on the Platform.
Plactive’s function is to offer users a means to access news content through the Platform, which facilitates the dissemination of content-by-Content Providers and Platform Partners. News content is directly uploaded or streamed onto the Platform-by-Platform Partners using Plactive’s communication platform, without Plactive’s involvement in the content procurement, uploading, streaming, or transmission processes. Plactive acts as an ‘intermediary’ as defined under the Information Technology Act, 2000, and associated rules. As an intermediary, Plactive bears no responsibility or liability for any news content on the Platform, including issues related to intellectual property rights infringement, defamation, obscenity, or any other legal violations.
Whether the content is Third Party Content or a Plactive Original, you are solely responsible for your use of the Platform and for viewing any content. Plactive shall not be liable for any loss or damage resulting from your reliance on or viewing of the content. By hosting Plactive Originals and allowing the hosting, uploading, or streaming of Third Party Content, Plactive does not provide any guarantees, warranties, or representations regarding the content. The content on the Platform is intended solely for entertainment or informational purposes. Plactive does not endorse the views, products, or services depicted in the content, nor is Plactive responsible for the quality or features of the content displayed on the Platform. Unless expressly stated otherwise, all characters, themes, and events in Plactive Originals are purely fictional, and any resemblance to actual events or persons, living or dead, is purely coincidental or unintentional.
Third Party Content will be available to you through various formats, including video-on-demand and live streaming, depending on the nature of the content and the discretion of the Content Owners and/or Platform Partners. Plactive Originals will also be provided in different formats at the discretion of Plactive. You may choose to view any content at your convenience and at a time of your choosing, subject to these Terms and any other applicable terms related to such content.
Please note that the availability of, and your ability to access, the Content or certain parts of the Services are (a) subject to applicable laws and the contractual arrangements between Plactive and the Content Owners and/or Platform Partners, and (b) may depend on your geographical location, internet/data connectivity, and the compatibility of your system with the Platform. Not all Content or Services will be available to all users. Due to the nature of internet/data connectivity and system compatibility, the Platform and Services may be accessible from various geographical locations.
By accessing the Platform and using the Services, you acknowledge and accept that you do so at your own risk, choice, and initiative. You agree to ensure that your use of the Platform and the Services complies with all applicable laws, including local laws in your jurisdiction. Furthermore, you acknowledge that the Services and Content may vary by location, time, and device. The quality and availability of your access to the Content or use of the Platform and Services are subject to various factors, including device specifications, internet availability and speed, and bandwidth.
Any information available on the Platform, including Third Party Content or other information (excluding Plactive Originals), has not been verified by Plactive. Consequently, Plactive shall not be responsible for any Third-Party Content or information. Plactive disclaims any obligation or liability for any loss or damage incurred by you as a result of relying on such Third Party Content or information.
By choosing to view or rely on any Third Party Content or information on the Platform, you implicitly accept the terms associated with such Third Party Content or information as provided by the Content Providers and/or Platform Partners. Plactive will not be a party to such arrangements and will not be involved in or liable for any actions or omissions by the Content Owners and/or Platform Partners.
You acknowledge that Third Party Content is created and owned by the Content Owners, who hold all rights, including copyrights, to such content. The Content is provided on the Platform for personal and non-commercial use only. You agree not to use it for commercial, promotional, resale, further distribution, or any other unauthorized purposes. Additionally, you agree not to use the service for public performances.
You further acknowledge that all intellectual property rights in (a) Plactive Originals are exclusively owned by Plactive, and (b) Third Party Content are either owned by the Content Owners or licensed to the Platform Partners. During the term of your Plactive membership, we grant you a limited, non-exclusive, non-transferable, revocable right to access the Platform and view the Content. Except for this limited right, no other rights, titles, or interests in any Content or the Platform are transferred to you.
We may terminate or place your account on hold to protect our interests or those of the Content Owners or Platform Partners from actual, suspected, or potential theft, loss, damage, or other fraudulent activity. Plactive reserves the right to immediately terminate, suspend, limit, or restrict your access to the Platform and/or Services at any time, without notice or liability, if we determine, at our sole discretion, that you have: (a) breached these Terms or the Privacy Policy; (b) violated any applicable law, rule, or regulation; (c) engaged in inappropriate or unlawful conduct; (d) provided false or inaccurate information; or (e) acted in any other manner that we deem appropriate in our sole discretion.
Any use or reliance on Content or materials obtained through the Platform is at your own risk. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted on the Platform, nor do we endorse any opinions expressed through such Content. You understand that by using the Platform, you may encounter Content that is offensive, harmful, inaccurate, or otherwise inappropriate, including postings that may be mislabelled or deceptive. Responsibility for Third Party Content lies solely with the Content Owners who originated it or with the Platform Partners who host, upload, and/or stream it. Plactive does not monitor or control the Content posted, uploaded, or streamed by Content Owners, Platform Partners, or their respective agents or affiliates, and we do not accept responsibility or liability for any such Content.
We reserve the right to remove any Content or user data that violates these Terms or applicable laws, including but not limited to copyright or trademark violations, impersonation, unlawful conduct, or harassment. Regarding Third Party Content, Plactive’s role is limited to providing a communication platform that enables the transmission of such Content directly from the Content Owners and/or Platform Partners to you.
Personal Information: We may use information such as device ID, location, or the account email address associated with an existing Plactive account to determine eligibility and any related offers. Personal information may be shared with our corporate entities and Platform Partners solely for the purpose of enhancing customer service.
Service Interruptions: You consent to sharing your information with third parties unless you specifically opt out. Additionally, access to the Services and the Platform may be occasionally suspended or restricted for repairs, maintenance, or the introduction of new features or services, without prior notice. We will endeavour to minimize the frequency and duration of such suspensions or restrictions.
If you encounter any offensive, abusive, or unlawful content on the Platform, you can report it to Plactive’s customer care.
Disclaimer of Representations and Warranties: Your access to and use of the Services or any Content are at your own risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Indemnification: You shall defend, indemnify, and hold harmless Plactive, its owners, affiliates, subsidiaries, group companies, partners, and their respective officers, directors, agents, and employees (“Indemnified Parties”) from and against any claim, demand, damages, obligations, penalties, losses, or actions (including reasonable attorneys’ fees) made by any third party against the Indemnified Parties or imposed on the Indemnified Parties, due to or arising out of your or your affiliate’s or relative’s: (a) breach of these Terms, the Privacy Policy, or any other policies; (b) violation of any applicable laws, rules, or regulations; (c) violation of the rights (including intellectual property rights) of a third party or Plactive; or (d) unauthorized, improper, illegal, or wrongful use of your Plactive account. This indemnification obligation will survive the expiration or termination of these Terms and/or your use of the Service.
Force Majeure: Plactive shall not be liable for any non-availability of the Platform and/or Services, or any portion thereof, caused by events beyond its control, including but not limited to Acts of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of public utilities, man-made disasters, or failures or non-performance by Content Owners or Platform Partners.
Governing Laws: These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Disputes arising from your use of the Services or in relation to these Terms shall be resolved in courts in Jaipur, India. You agree to submit to the jurisdiction of these courts, and any proceedings initiated by you must be brought exclusively before these courts.
Severability: If any provision of these Terms is found to be invalid, void, or unenforceable, that provision shall be severed from the remaining provisions, which will continue to be in full force and effect.

Plactive E-Learning ApplicationYou can purchase e-books through Plactive and obtain unlimited access to them. The right to use e-books is non-exclusive, non-transferable, and for personal, non-commercial use only, subject to these Terms of Use. You must not share access to e-books with others. Plactive is not responsible for any loss or damage caused by the electronic device used to view the e-book or if the device does not support the e-book application. PROFANITY POLICY
Plactive is committed to maintaining a respectful and inclusive environment. As such, we prohibit the use of language that is racist, hateful, sexual, or obscene in any public area of the site. This policy applies to text within listings, Seller pages, and all other areas visible to Users. If profane words are part of an item title, Sellers are allowed to ‘blur’ the majority of the offending word with asterisks (e.g., s*** or f***). Section 294 of the Indian Penal Code lays down the punishment for obscene acts or words in public. The other section of Indian Penal code which deal with obscenity are 292 and 293.

Plactive reserves the right to delete any product review containing offensive language at its sole discretion. Additionally, if a review unfairly disadvantages a product or unjustly increases its popularity, Plactive may also remove the review and blacklist the customer from posting further reviews.
REPLACEMENT GUARANTEE
The Replacement Guarantee aims to assist Buyers who have encountered issues with products purchased from qualified Sellers on the Platform. If a defect is found at the time of delivery or within the specified days from the delivery date, the Buyer can request a replacement from the Seller.
IMPORTANT NOTES on FRAUD
Fraudulent Claims: If Plactive suspects or discovers that Buyers or Sellers are involved in fraudulent activities, such as submitting false or misleading claims, Plactive reserves the right to suspend, block, or restrict the involved accounts. Legal action, including civil and/or criminal proceedings, may be initiated against users who provide false information or engage in fraudulent behaviour.
Criminal Offenses: Individuals who knowingly file fraudulent complaints or provide false information may be prosecuted to the fullest extent of the law.

RETURNS POLICY
A “Return” refers to the action of returning a purchased item to the Seller on the Plactive Platform. Returns may be requested in the following situations:
The item is defective.
The item was damaged during shipping.
The product was missing.
The wrong item was sent by the Seller.

Seller Acceptance: Sellers can choose to accept returns regardless of their policy.
Dispute Resolution: If a Seller rejects a return request, Buyers can file a dispute under the Buyer Protection Program.

DISPUTE RESOLUTION POLICY
Overview: Transactions on Plactive generally proceed smoothly. However, issues may occasionally arise between Buyers and Sellers. To address these issues, Plactive has established a Dispute Resolution process to facilitate fair and effective resolution.
What is a ‘Dispute’? A ‘Dispute’ is a disagreement between a Buyer and a Seller regarding a transaction on the Platform.
How Does a ‘Dispute’ Occur? Disputes arise when a Buyer or Seller is not satisfied with the resolution of an issue or complaint related to a transaction. Before raising a dispute, both parties are encouraged to resolve the issue directly.
Dispute Creation Process:

In Favor of the Seller: If the dispute is resolved in favour of the Seller, the Buyer is not entitled to a refund.

BUYER PROTECTION PROGRAM
Overview: Plactive’s Buyer Protection Program is designed to assist Buyers who are unable to resolve disputes with Sellers or are dissatisfied with the resolution provided. If a Seller cannot provide a refund or replacement, Plactive will actively work to resolve the issue.
Dispute Resolution: If you encounter a problem with a transaction and are unable to resolve it directly with the Seller, you can seek assistance from Plactive’s Customer Support team. To initiate a dispute, please contact us via / . Our team will investigate the case for potential fraud and verify if you have been blacklisted or blocked from making purchases on the Platform.
Customer Support Role: Our Customer Support team does not facilitate conference calls but acts as an intermediary between the Buyer and Seller. We may provide both parties with access to each other’s Display Names, contact details, and relevant information pertaining to the dispute. The final decision for settling the dispute is at Plactive’s discretion.
Eligibility and Restrictions:
Eligibility: Only Buyers who have purchased products through Plactive are eligible for the Buyer Protection Program.
Dispute Filing: Disputes must be filed within 45 days from the date of delivery of the product.
Damage Responsibility: Any damage or loss occurring after delivery is the Buyer’s responsibility. Buyers should refuse delivery of damaged items.
Resolution Attempt: Buyers must first contact the Seller to resolve the issue. If unresolved, a dispute can be raised with Plactive.
Fraudulent Claims: Fraudulent charges and claims are not covered under this program.
Chargebacks: If a chargeback is initiated through a credit card issuing bank, it will not be covered by this program. Sellers can file claims through the Seller Protection Program in such cases.
Blacklisted Buyers: Buyers who are blacklisted or blocked are not covered by the Buyer Protection Program.

Overview: The Buyer Protection Program is designed to assist Buyers who are unable to resolve disputes with Sellers or are dissatisfied with the resolution provided. If a Seller cannot provide a refund or replacement, Plactive will actively work to resolve the issue.
Eligibility and Restrictions:
Claim Limit: Buyers can make a maximum of 5 claims per year on Plactive. Claims that are withdrawn do not count towards this limit.
Lifetime Limit: Buyers who have reached their maximum lifetime limit for claims are ineligible for the program.
Coverage Limit: The coverage amount is limited MAXIMUM UPTO to Rs. 5000/- per claim whichever is lowest.
Dispute Filing: Disputes must be filed within 7 days from the date of delivery of the product.
Product Issues: The program does not cover technical or manufacturing defects.
Buyer Remorse: Claims arising from buyer remorse, where products are bought mistakenly or the Buyer changes their mind, will not be entertained.
Damage Responsibility: Damage or loss occurring after delivery is the Buyer’s responsibility. Buyers should refuse delivery of damaged items.
Resolution Attempt: Buyers must first contact the Seller to resolve the issue. If unresolved, a dispute can be raised with Plactive.
Claims Processing: investigating and processing of a claim can take up to 30 days or longer in some cases.
Verification: Plactive will verify all disputes raised and process only valid and genuine claims.
No Automatic Refund: Raising a dispute does not automatically entitle the Buyer to a refund or replacement. Each dispute will be assessed based on its validity.
Liability: Plactive is not responsible for any direct or indirect losses, expenses, or costs incurred by Buyers or Sellers.
LEGAL AND DISCIPLINARY ACTIONS
Fraudulent Claims: Plactive reserves the right to initiate civil and/or criminal proceedings against Users who file invalid or false claims or provide misleading information. Such Users may also face suspension, blocking, or cancellation of their Display Name and related accounts.
Final Decisions: Decisions made by Plactive under the Buyer Protection Program are final and binding on Users.
Program Changes: Plactive reserves the right to modify or discontinue the Buyer Protection Program without prior notice.
Exclusions:
Delayed Shipments: Claims for losses due to delayed shipment or delivery by the Seller will not be covered by this program.

BUYER PROTECTION POLICY
Rights and Actions: Plactive reserves the right to initiate civil and/or criminal proceedings against any User who files invalid or false claims, or provides false, incomplete, or misleading information. In addition to legal actions, Plactive may, at its sole discretion, suspend, block, restrict, or cancel the Display Name [and its related Display Names] of such User. Furthermore, Plactive may disqualify the User and any related users from availing protection through this program.
Decisions: Decisions made by Plactive under the Buyer Protection Policy shall be final and binding on Users.
Modifications and Discontinuation: Plactive reserves the right to modify or discontinue the Buyer Protection Program / Policy without any prior notice to Users.
Claims Excluded: Claims related to loss incurred due to delayed shipment or delivery of items by the Seller will not be entertained under this program.
Customer Support: The Plactive Customer Support Team may seek additional information or clarification from the Buyer to facilitate dispute resolution. If the Buyer does not respond within 10 days of such a request, the dispute will be auto-closed in favour of the Seller.
Disputes via Chargeback:
Item Not Received: If a chargeback is filed because the Buyer has not received the item, a refund will be processed in accordance with the dispute policies.
Unauthorized Chargeback: If a chargeback is filed for a transaction that the Buyer did not authorize, a refund will be processed in accordance with the dispute policies.
Item Not as Described: If a chargeback is related to the item not meeting the Buyer’s expectations, the dispute will be resolved in accordance with the dispute policies.
Sellers expressly agree that issuing correct and complete invoices is their sole and primary responsibility. Invoices must state “Active by Plactive”; failure to do so may render Sellers liable for chargebacks.
EMAIL ABUSE & THREAT POLICY:
Threats of Bodily Harm: Plactive does not permit explicit threats of bodily harm and will take action if such threats are made.
Misuse of Plactive System: Plactive investigates any misuse of its system and will take appropriate action.
Spoof (Fake) Emails: Plactive will never request sensitive information via email. If you receive a spoof (fake) email, please report it to us via the ‘Contact Us’ (create link) tab.
Spam (Unsolicited Commercial Email): Plactive’s spam policy applies only to unsolicited commercial messages sent by Users. Sending spam messages is prohibited.
Offers to Buy or Sell Outside of Plactive: Offers to buy or sell listed products outside of the Plactive Platform are prohibited and may pose a fraud risk.
User Conduct and Threats Policy
Plactive strictly prohibits threats of physical harm between users via any method, including phone, email, or public message boards on the Platform. Violations of this policy may result in:

Third-Party Platforms and Affiliates
Plactive does not accept responsibility or liability for actions, products, content, or services provided by affiliates or third-party platforms linked through our Platform. REPORTING OF INFRINGEMENT VIOLATION and REPORTING OF LISTING VIOLATIONS (RIV)
Plactive Infringement Policy
Objective: Plactive is committed to ensuring that all products listed on its platform comply with intellectual property laws. To maintain the trust of both buyers and sellers, we have established an Infringement Verification process that allows intellectual property owners to report listings that infringe on their rights.
Policy: Plactive respects the intellectual property rights of third parties and is dedicated to protecting these rights, including copyrights, trademarks, and other intellectual property (“IP”). Our policy is to promptly address clear notices of alleged IP infringement.
Response to IP Infringement Notifications:
Upon receiving a valid notice of IP infringement, Plactive will take the following actions:
Removal or Disabling of Infringing Material:Plactive may expeditiously remove or disable access to the material that is claimed to be infringing.
Notification to the Seller:The seller responsible for the allegedly infringing material will be notified and provided with a copy of the infringement notice.
Legal Actions:Plactive reserves the right to take any appropriate legal action in accordance with applicable laws at the time of notification. Previous actions taken by Plactive, such as removal or disabling of material, do not prevent us from taking contrary actions in the future if deemed necessary.
Plactive is committed to protecting intellectual property rights and has established the Plactive Reporting of Infringement and Violation Verification process for reporting listings that may infringe upon intellectual property rights. We aim to maintain trust among buyers and sellers by promptly addressing such violations.
For Verified Rights Owners: If you are a Verified Rights Owner and wish to report a potentially infringing listing, please use the FIV process. Only intellectual property rights owners can report infringements. If you are not the rights owner, please encourage them to contact us directly.
If Your Listing is Removed: If your listing has been removed through RIV and you believe this was an error, please contact us to resolve the issue.
